    TERMS & CONDITIONS

    These terms and conditions are entered into by and between Base 13 Fitness / Rise 13 Reformer Pilates (hereinafter: "the Company") and You (hereinafter: "the Member").

    Services

    Membership entitles the Member to use the services and facilities made available by the Company in accordance with their membership type.

    2

    Membership

    Membership is personal to the Member and may not be shared, transferred, or assigned to any other individual.

    3

    Age Limit

    The Member confirms that they are 18 years of age or older.

    4

    Health & Medical Declaration

    By entering into membership, the Member confirms that they are in good physical condition and have no known medical reason why they should not participate in exercise, and that they do not suffer from any condition that would make participation unsafe. Where relevant, they will seek advice from a qualified medical professional prior to participation.

    If at any point the Member sustains an injury, develops a medical condition, begins taking medication that may impact exercise performance or safety, or becomes pregnant — they must inform a member of staff prior to attending any further sessions.

    The Company reserves the right to require a consultation prior to returning to training and may restrict participation where necessary for safety. Members are responsible for monitoring their own condition and must stop immediately if experiencing pain, dizziness or discomfort.

    PRE- AND POSTNATAL PARTICIPATION: If you are pre- or postnatal, you must only attend sessions run by an instructor with an appropriate pre- and postnatal qualification. This information can be found in the coach bio. It is your responsibility to ensure you book onto a suitable class. If you attend a session where the instructor does not hold the relevant qualification, you may be asked to leave the session and reschedule.

    The Company does not provide medical advice. Any assessments are for training purposes only.

    Liability for Damage

    Members are responsible for any loss or damage caused to equipment, facilities, staff or other Members as a result of negligent, reckless or deliberate actions. The Company reserves the right to recover reasonable repair or replacement costs.

    Assumption of Risk & Limitation of Liability

    Members acknowledge that participation in training carries inherent risks, including (but not limited to) injury, strain, falls or equipment-related incidents.

    By participating, Members accept these risks and agree to: use equipment safely and as instructed; follow all coaching guidance; and only perform movements within their capability.

    The Company is not liable for: injuries arising from the inherent risks of exercise; misuse of equipment or failure to follow instruction; or loss or damage to personal property (unless caused by negligence).

    Nothing in these Terms limits liability where it cannot legally be excluded.

    Lockers & Storage

    Lockers are provided for temporary use only and must be emptied after each visit. The Company accepts no responsibility for items stored unless loss results from negligence.

    Lost Property

    Items will be held for up to two weeks. After this period, items may be donated or disposed of. The Company accepts no liability for unattended belongings.

    Code of Conduct

    Members agree to conduct themselves in a respectful, responsible, and safe manner at all times while on the Company premises or participating in Company activities. Members must:

    • Treat staff, coaches and other Members with respect and courtesy
    • Follow all safety instructions and gym rules
    • Use equipment appropriately and return it after use
    • Maintain appropriate hygiene and attire suitable for training
    • Refrain from behaviour that is unsafe, abusive, discriminatory, intimidating or disruptive
    • Not attend while under the influence of alcohol, illegal drugs, or any substance that may impair safe participation

    For health and safety reasons, coaches reserve the right to refuse participation in any session if they reasonably believe the Member is intoxicated or otherwise unfit to train safely. The Company operates a zero-tolerance policy towards harassment, abusive language, threatening behaviour, discrimination, or deliberate damage to equipment.

    Suspension or Termination

    The Company reserves the right to suspend or terminate a membership where a Member breaches the Code of Conduct; engages in behaviour that puts themselves or others at risk; causes damage to equipment or property; fails to follow reasonable staff instruction; or engages in conduct that may harm the reputation or safe operation of the Company.

    Where appropriate, the Company may issue a verbal warning, followed by a written warning, prior to suspension or termination. However, in cases involving serious misconduct, unsafe behaviour, or risk to others, membership may be suspended or terminated immediately. Any decision to suspend or terminate membership will be reasonable and proportionate in the circumstances.

    Access & Security

    Classes and coaching sessions are available in accordance with the schedule published on the company booking system. Class times, instructors, and session formats may be subject to change where reasonably necessary. While last minute changes may occasionally be made without prior notice, the company will endeavour to communicate any significant changes as soon as reasonably practicable.

    Members must not: permit access to non-members; share access codes or entry credentials; allow unauthorised persons to enter the facility; or remain on the premises outside permitted hours.

    For security purposes, the company may operate CCTV within the facility in accordance with applicable data protection legislation. Further details are set out in the Privacy Policy.

    Late Arrival Policy (Reformer Pilates)

    Participants must arrive at least 5–10 minutes before the session start time. This allows time for check-in, equipment setup and any necessary health screening.

    No entry is permitted 2 minutes after the class has started. This is to ensure your safety, the safety of others, and the quality and structure of the session.

    Late arrivals that result in refused entry will be treated as a missed session. Sessions will not be refunded or credited.

    Cancellation Policy

    Members must provide a minimum of 6 hours' notice to cancel or reschedule a session.

    EARLY MORNING SESSIONS (6AM–9AM): A 9-hour cancellation window applies:

    • 6:00am sessions must be cancelled by 9:00pm the night before
    • 7:00am sessions must be cancelled by 10:00pm the night before
    • 8:00am sessions must be cancelled by 11:00pm the night before
    • 9:00am sessions must be cancelled by 12:00am the night before

    Cancellations made outside the applicable window will result in the loss of the session credit. Failure to attend without cancelling will be recorded as a no-show and will also result in the loss of the session credit.

    Waitlist Policy

    Where a class is fully booked, Members may join the waitlist. By joining the waitlist, Members confirm they are available to attend the session should a space become available.

    • If a space becomes available more than 13 hours before the class, Members will be automatically moved into the class and standard cancellation rules will apply.
    • If a space becomes available less than 13 hours before the class, the Member will be notified and given a 30-minute window to accept the space before it is offered to the next person on the waitlist.

    If a Member is moved into a class from the waitlist and fails to attend without cancelling within the applicable window, this will be treated as a no-show and the credit will be lost.

    Dress Code

    GRIP SOCKS: Grip socks must be worn at all times for safety. Socks can be purchased in-studio if required.

    CLOTHING: Form-fitting clothing is recommended. Loose clothing should be avoided. Hair should be tied back for safety.

    Monthly Membership

    Monthly memberships are charged on the date of purchase / 1st day of each month. The membership extension is triggered by the payment of a subsequent month. All sessions must be used between the first and last day of the membership monthly period and will expire at the end of the month.

    The Company does not take responsibility for any unused sessions; these will be invalid for the following month and no refund given. If no payment is made, the membership stops at the end of the contracted month.

    The Company will attempt to collect payment on up to three (3) consecutive working days where a payment attempt fails. If payment remains unsuccessful, the full membership fee for that billing period will remain due and payable.

    Membership Freezes

    Members may request a temporary suspension ("freeze") of their membership by submitting an email to risereformer@base13fitness.co.uk.

    • Freezes are permitted for a maximum of one (1) month per calendar year
    • Require payment of 50% of the applicable monthly membership fee during the freeze month
    • Upon resumption, the Member will receive a 50% discount on the first active billing month following the freeze
    • The discounted return month will be applied automatically and may not be deferred or transferred

    Freeze requests must be received at least 14 days prior to when the freeze is to commence. Late requests may not be processed before the next billing cycle. Freeze requests cannot be applied retrospectively.

    Termination of Membership

    Members wishing to terminate their membership must provide 30 days' written notice via email to risereformer@base13fitness.co.uk.

    Membership fees remain payable during the 30-day notice period. Any scheduled payments within this period will be processed as normal. If written notice is not received prior to a scheduled payment date, the payment will be processed.

    Membership fees are charged on a monthly basis and are not refundable for unused sessions within a billing cycle.

    Price Adjustments

    Membership fees may be reviewed periodically. Members will be provided with at least one month's notice of any changes.
